Privacy Policy
Effective date: 16 October 2026
1. Who we are
iComply Consulting Group (ICG, we, us) is the business name of Moufid Sukkar, ABN 48 327 194 907, of 85 Victoria Road, Drummoyne NSW 2047. ICG provides building diagnostics, waterproofing design and review, defect and compliance assessment, inspection and testing, and expert witness services in Australia.
This policy explains how we collect, hold, use and disclose personal information. We handle personal information in line with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth), and we have chosen to do so whether or not the Act applies to us as a small business.
2. What personal information we collect
The information we collect depends on how you deal with us. It may include:
Contact details: name, job title, company, phone, email and postal address. Property and project information: site addresses, strata plan and lot details, owner and occupant names, access arrangements, and building records such as drawings, specifications and defect reports. Site photographs and video: taken during inspections. These may incidentally show people, vehicles, personal belongings or the inside of homes. Engagement and billing records: proposals, contracts, invoices, payment history and bank details supplied for payment. Legal and dispute material: briefs, pleadings, correspondence and evidence supplied by solicitors, insurers, owners corporations or parties to proceedings. Website and communications data: enquiry form content, emails, call records, and basic technical data such as IP address and browser type.
We do not seek sensitive information (such as health, racial or religious information). If it is in material provided to us, for example in a litigation brief, we use it only for the engagement it was supplied for.
You can deal with us anonymously or under a pseudonym for general enquiries. For an engagement, inspection or report we need to know who you are.
3. How we collect it
We collect most information directly from you: through enquiries, our website form, proposals, contracts, site meetings and correspondence. We also collect it from third parties connected to a project, including builders, developers, architects, engineers, strata managers, owners corporations, solicitors, insurers, certifiers, councils and the NSW Building Commission, and from public sources such as the strata roll, land title records and court registries.
If you give us information about another person, such as an occupant or subcontractor, please make sure they know you have done so and where to find this policy.
4. Why we collect, use and disclose it
We use personal information to: respond to enquiries and prepare fee proposals; arrange site access and carry out inspections, testing and reviews; prepare reports, specifications, drawing mark-ups and expert evidence; invoice, collect payment and keep business records; meet our legal, insurance, professional and court obligations; manage complaints, claims and disputes; and improve our services.
We may send occasional updates about our services. You can opt out at any time by replying "unsubscribe" or contacting us.
5. Who we disclose it to
We disclose personal information only as needed for the purposes above, including to: the client who engaged us and parties the client authorises (for example, its builder, consultants or solicitors); courts, tribunals (including NCAT), other parties' experts and legal representatives in proceedings, as required by court rules or directions; regulators and authorities where the law requires; our insurers, professional advisers, accountants and debt recovery agents; and service providers who host or process data for us, such as cloud storage, email, inspection software and accounting systems.
We do not sell personal information.
6. Overseas disclosure
Some of our service providers store data on servers outside Australia, including the United States, where our website host is based. We also operate partly from the United Arab Emirates, so information may be accessed from there. We take reasonable steps to ensure overseas recipients handle personal information consistently with the APPs.
7. Storage and security
We hold information electronically in password-protected, access-controlled systems, and in limited paper files kept secure. We use multi-factor authentication where available and limit access to people who need it. No system is completely secure; if we suffer a data breach likely to cause serious harm, we will notify affected people and act in line with the Notifiable Data Breaches scheme where it applies.
8. Retention
We keep project files, reports and engagement records for at least 7 years after completion, and longer where a claim, proceeding or statutory limitation period (including the 10-year building defects limitation in NSW) makes that prudent. We then destroy or de-identify the information securely.
9. Automated decisions
We do not make decisions about individuals using computer programs that operate substantially without human involvement. Professional opinions in our reports are formed by our consultants.
10. Website and cookies
Our website is hosted by GoDaddy, which also processes the details you submit through our enquiry form. The site may use cookies and analytics tools to understand how visitors use it. These collect technical data rather than identifying you directly. You can disable cookies in your browser. Linked third-party websites have their own privacy policies.
11. Access and correction
You can ask for access to, or correction of, personal information we hold about you by contacting us. We will respond within 30 days. We may refuse access where the law allows, for example where the information relates to existing or anticipated legal proceedings, or is subject to legal professional privilege or a court order. If we refuse, we will tell you why.
12. Complaints
If you have a privacy concern, please contact us first and we will respond within 30 days. If you are not satisfied, you can complain to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
